ILA South West Regional Training

09/10/12

The ILA held a South West regional training event in Bristol on 9 October 2012, when ILA members and practitioners from the South West and Wales were educated and entertained in equal measure by The Honourable Mr Justice Morgan, the Chancery Supervising Judge for the Wales, Western and Midland Regions, whose presentation included a lecture on "Rent as a liquidation expense or an administration expense"  and the former ILA President John Verrill of Chadbourne & Parke, who outlined the background and cross-border issues raised in Rubin v Eurofinance, which was heard by the Supreme Court in May 2012 and on which judgment was delivered on 24 October 2012.

The paper by The Honourable Mr Justice Morgan, who prior to appointment to the bench was a landlord and tenant specialist at Falcon Chambers, will be of considerable interest to ILA members generally, as the Judge has questioned whether the decisions in Goldacre and Luminar were correct in applying a rigid accrual basis for recovery. A copy of the Judge's paper can be accessed below.
